Fikile Mbalula has filed an application in the Eastern Cape High Court to overturn a ruling that stopped the African National Congress’ provincial conference in March.
The conference was halted after a group of dissatisfied ANC members approached the court, alleging irregularities in the build-up to the gathering and claiming that several internal disputes had not been resolved. The court ruled in favour of the applicants, effectively preventing the conference from proceeding.
In court papers submitted on behalf of the ANC, Mbalula argued that the application brought by the group was “fraudulent”. He further maintained that the members failed to exhaust the party’s internal dispute-resolution processes before taking the matter to court.
The legal challenge comes as the ANC in the Eastern Cape undergoes a leadership transition. A Provincial Task Team has recently been appointed following the expiry of the Provincial Executive Committee’s term.
